High Tech Services Licensing

This license governs use of the accompanying software ("Software"), and your use of the Software constitutes acceptance of this license. 

1. The license is for the VB.NET or C# source code. 
2. This is not "open source" or freeware software. 
3. You can not remove any copyrights from the Software. 
4. You have joint rights to the software.  Meaning, we can continue to sell the Software as we have for three decades AND you can modify the Software to fit your requirements. 
5. If you distribute the Software you do so only under this License (i.e. you must include a complete copy of this License with your distribution).   Distribution is strictly limited as outlined in this license. 
6. The license is per company, per site/location, and per plant that uses the software.  For example, at a single plant, company, and site -- you can copy the Software to as many computers as you want.  If a company has two plants then they are required to buy two licenses.  If one site has four different plants or companies then each plant and company would have to buy a license.  If one company has two different sites, then each site must purchase a license.  We offer discounts for multiple purchases. 
7. The Software comes "as is", with no warranties. No expressed, implied or statutory warranty, including without limitation, warranties of merchantability or fitness for a particular purpose or any warranty of non infringement.
8. The license is transferable, without charge, to a company that buys the entire plant or facility and its assets provided that the company will continue operations "as-is" and in whole.  In cases such as bankruptcy, auction, or selling off assets piecemeal, the license ends automatically. 
9. The license or Software can not be resold. 
10. High Tech Services will not be liable for any of those types of damages known as indirect, special, consequential, or incidental related to the Software or this License, to the maximum extent the law permits.
11. None of the source code, applications generated using the source code, or any other derivative can be sold. 
12. If you sue anyone over patents that you think may apply to the Software or use of the Software, your license to the Software ends automatically.
13. No portion of the source code can be released outside the plant in any manner or format. 
14. The license can only be purchased by a company whose primary operations are manufacturing or production (i.e. the conversion of raw materials into finished goods), processing (such as laboratories) or the inventory, or transportation of materials for manufacturing, production or processing. 
15. The license can not be bought by software development companies, distributors, or other third parties and used for multiple projects. 
16. The purchaser is responsible for securing the source code and is responsible for all High Tech Services potential losses if the source code is released outside of their facility. 
17. High Tech Services reserves the right to audit companies, users and systems to verify their compliance with these terms. 
18. Your rights under this License end automatically if you breach it in any way.
19. All rights not expressly granted to you in this license are reserved.
20. This software is subject to the laws of the United States of America.
